Bankruptcy Code

The law establishing the rights, rules and consequences of filing bankruptcy are set forth in Title 11 of the United States Code, referred to as the Bankruptcy Code. It is important to note that, although the Bankruptcy Code consists of federal legislation, bankruptcy law is not uniform across the nation. California state significantly affect a debtor's rights by providing California specific laws regarding a debtor's exemptions. Accordingly, it is important to only obtain California specifc legal advice rather than relying on information from out of state.

Further, the Bankruptcy Code was extensively revised in 2005 which renders old information obsolete. Accordingly, it is important to ensure that information obtained regarding bankruptcy law is current.
